hi guys just bought a vantex sherman wich arrived in a very bad state even the carton was in a bad state having taken pics of the carton even before opening this item i discovered DHL had damaged internal and external parts when they charge me £50.35 for checking it being in constant contact with the vendor they just offered parts to wich i have no knowledge to repair now paypal need a expert advice from a shop to back up my case or the chinese get thier money and i get a really damaged item all pics i logged and sent but to no result i need an expert to see the damage email me a file so i can at least back my claim i could lose everything ive contacted welsh dragon just waiting a reply im in a desperate situation they have given me 3 day to get a pro opinion or i lose all my monet £1300 gutted can anyone help me please

Just to answer in Bullet points...

1. I have to ask why do Paypal say ONLY 3 days for an expert ??... GET PAYPAL TO CLARIFY THIS QUOTE.....' expert advice from a shop'
You do NOT need to be an expert to see that it is broken !!..Paypal has a 45 day period to lodge a complaint in so why 3 days ??

2. DHL damaged it so THEY must be responsible, THEY shipped it, presumably insured to some degree as they are a courier and by THEIR OWN ADMISSION..They opened and then damaged it.So THEY PAY !! Urgent letter of complaint to them !!

3. Sale Of Goods Act is OUT....as they are Foreign....

4. Certainly with a Credit Card and presumably with Paypal...since you bought the item through THEM...Then THEY act as your 'Agent' and if so then THEY are responsible for the LOSS....If you buy a foreign holiday on a credit card and the travel firm goes bust then the credit card as your Agent has to cover the loss...
Let me look into Paypal a bit and THEIR status as an agent.....and get back to you....

AS FAR AS I CAN SEE THE LAST SENTENCE ABOVE IS THE 'WINNER'...SO ..
OPEN A DISPUTE NOW..............that gives you a 45 day window in which to fight...

thanks alb so far paypal are fighting my case after opening the dispute now its a waiting game
i just want people to know when or if you purchase a vantex from the supplier the item may not be what you expect or the service from the company is not either so be warned if buying one of these make sure you use paypal and the item doesnt arrive in a utter shambles with allsorts of damage

I'm very sorry to hear of your plight, are you based in uk and which supplier did you use to purchase the tank because if you live in uk and purchased it in the uk, your contract would be with the seller under the 1975 sale of goods act.
So short story is, if tank arrives broken then its down the supplier to either put right or offer refund in full as item has arrived to you is not fit for the job it was purchased for, it would be down to the agent to claim from dhl, not you. Try talking to trading standards they can be very helpful at getting company's to sort these problems out.

paypal dispute ended ....thank god ! had a partial refund of £480 so sort of happy now its just getting it working but i have an expert on the case helping me with the internals

It is always bad news when there is a dispute between buyer and seller but it sure is good to have Paypal stepping up and doing the right thing, although they did seem to need a bit of a push this time. shaun
